TASK 2

Criminal Law & Civil Law; What are the differences between these?

Criminal Law is in relation with actions that have been caused illegally they are therefore prosecuted and the defendant is found and declared as guilty of the crime. This means that the defendant has gone against societies wills and after being declared as guilty they are punished with fines, jail/probation.

Civil Law however, deals with disagreements where no crime has been done between the public. If taken to court the defendant needs to stand up against the evidence which proves them guilty by 50% and prove preponderance of evidence. Criminal Law suits need to prove beyond reasonable doubt.


Health and Safety; What H&S checks would you make before a photoshoot - List 5 factors and consider whilst shooting on Location or Studio?

  1. Studio: Ensure that all fire exits are clear and accessible in any situation.
  2. Studio/Location: To ensure that all lights have been set up correctly, make sure that the bulbs have a sufficiant amount of life left in them for the whole photoshoot. And during the shoot do not cover the lights with anything that could cause a fire, electrocution and put people at risk.
  3. Studio: Whilst setting up the backdrops make sure that it is tapped to the floor to avoid tripping over when walking onto the shooting space. And make sure that the poles holding the back drop and lifting it are correctly fastened into place ensuring that they do not fall onto the model during the shoot.
  4. Location: If the weather turns and it becomes raining or windy, swiftly move the equipment and put it into a safe place inside to keep dry, this will avoid electrocution and damage of expensive equipment. Make sure it is clear and easy to get to if needed.
  5. Studio/Location: Make sure that all wires are easy to be seen, this will avoid someone falling over and possibly pulling out wires from cameras/lights/props which could be dangerous. Make sure that all sharp surfaces are noted.

What is their full name?
  • ASA stands for Advertising Standards Authority

Who do they regulate? Which area's of the Media?
  • The ASA regulates in Advertising throughout the UK's Media industry.
  • The area's they regulate in are within the Television, Internet, Sales promotion and Direct marketing.

Are they regulatory or self-regulatory?
  • The ASA are a self-regulatory company.
Give 2-3 examples of the specific codes that they put into practise?
  • Some of the specific codes that ASA put into practise to lay down the rules of advertisement, agencies and media owners. The ASA rules are separated into different sections depending on what type of advertisement you're doing. EG: Radio, Tv, Magazine.
  • One specific code that they put into practise for broadcasting (BCAP Codes) The BCAP Television Advertising Standards Code sets out the rules that govern advertisements on any television channel licensed by Ofcom. The rules are framed to ensure that advertisements are ‘legal, decent, honest and truthful’ and do not mislead or cause harm or serious or widespread offence."
  • "No promotion or promotional item should cause serious or widespread offence to the audience addressed."
  • The ASA are that everything that is consumed to the public is decent and trustworthy. The Company Codes are what ensure that the marketing world and advertisement do not mislead the public. They hold weekly meetings in which they discus these codes and ensure that the company does not stop giving it's best and for ways to make their company larger and more successful.

  • The NUJ stands for National Union of Journalists. Which is a member of the International Federation of Journalists (IFJ)

Who do they regulate? Which area's of the Media?
  • NUJ regulates within the media as freelancers, reporters, writers, journalists, illustrators, editors and photographers. The area's of Media and new Media broadcasting in which this stretches across are Newspapers, Magazines, Books.
Regulatory or Self-regulatory?
  • The NUJ are a Self-Regulatory Company.

Give 2-3 examples of the specific codes they put into practise?
  • Since 1936 when the NUJ and the codes of conduct first became big it is now part of all the rules that a journalist has to agree to on joining the union and strive to for fill.
  • First of all and simply, "NO plagiarism."
  • "Resists threats or any other inducements to influence, distort or suppress information"
  • " At all times upholds and defends the principle of media freedom, the right of freedom of expression and the right of the public to be informed"

  • PCC stands for Press Complaints Commission

Who do they regulate? Which area's of the Media?
  • The PCC regulate broadcasting press, Newspapers and Magazines. It deals with any public complaints against the Media company on it's editorial content.


Are they regulatory or Self-Regulatory?
  • The PCC are a Self-Regulatory company.

Give 2-3 examples of the specific codes that they put into their practise?
  • All members of the PCC and press have a duty to maintain high professional standards in all that they do, their work is all shown to the public, the codes when followed ensure that the piece is final and ready for public viewing and should not have any bad feedback from the public. Some of the PCC codes are;
  • "It is unacceptable to photograph individuals in private places without their consent"
  • "A significant inaccuracy, misleading statement or distortion once recognised must be corrected, promptly and with due prominence, and - where appropriate - an apology published."
  • "Journalists have a moral obligation to protect confidential sources of information."
